General Terms and Conditions for Book Orders

§ 1 Scope

The following General Terms and Conditions shall apply to the business relationship between Carl Hanser Verlag GmbH & Co. KG (hereinafter: Seller) and the Buyer.

§ 2 Ordering

You have the option to browse our offer at your leisure. If you discover something interesting, place the product in your virtual shopping cart. To do this, click on the coloured field labelled "Buch / E-Book in den Warenkorb" (Book / E-book to cart) that we have displayed under the product. You have the option to remove products from your shopping cart at any time. 

You initiate the ordering process by clicking the "Warenkorb" (Shopping Cart) button, which is always available to you in the top right corner of the website. You will then receive an overview of all products you have placed in the shopping cart, as well as any shipping costs that may be incurred in connection with your order. You have the option to remove products from the shopping cart again. 

Before submitting your order by clicking the "Zahlungspflichtig bestellen" (Place order subject to payment) button, you have the option to view and correct your entries at every stage of the ordering process. To change the order quantity, overwrite the quantity specified in the corresponding field. To delete products, click the "Aus dem Warenkorb entfernen" (Remove from cart) button under "Einkaufswagen" (Shopping Cart). 

Before an order is triggered, you must declare your agreement with these GTC in the overview of your order. By pressing the "Zahlungspflichtig bestellen" button, your order is triggered and forwarded to us. With your order, you declare bindingly that you wish to purchase the goods. 

§ 3 Contract Conclusion 

When placing an order, you conclude a contract with: Carl Hanser Verlag GmbH & Co. KG, Vilshofener Str. 10, 81679 München. You will be immediately informed about the receipt of your order with an email labelled "Bestellbestätigung" (Order Confirmation), which includes an overview of your order and these GTC, including the statutory cancellation policy. The order confirmation does not yet constitute acceptance of your offer. The acceptance of your order takes place upon execution by us, upon shipment for print books, and upon provision of the download link via email for e-books. The language available for the conclusion of the contract is German.

§ 4 Reservation of Non-Availability

If a work is not available at the time of ordering, we will indicate this to you before you complete your order. If works are displayed to you with the note "Zur Zeit nicht verfügbar" (Currently not available), they are not deliverable for an extended period, and ordering in the webshop is then not possible. You will receive a corresponding notification in the ordering process and then have the option to remove the work from the shopping cart or cancel the ordering process.

If we indicate the availability as "Dieses Buch wird gerade nachgedruckt" (This book is currently being reprinted), we are currently reprinting these works, and they are therefore not available on short notice. You will receive a corresponding notification during the ordering process. It usually takes five to ten working days until the books are delivered by the printing company and received back into the warehouse, after which your order will be executed immediately and without additional costs. If you do not wish for subsequent delivery, you have the option to remove the title from the shopping cart during the ordering process.

In the event that your order contains works with both the status "sofort lieferbar" (immediately available) and "Dieses Buch wird gerade nachgedruckt" (This book is currently being reprinted), we will execute the order in partial deliveries. This will not result in any additional costs for you. In the event that availability is permanently not given, we reserve the right to refrain from executing your order and to withdraw from the contract. In this case, we will inform you immediately about the non-availability and immediately refund any purchase price already paid by you.

§ 5 Prices

All prices are final prices in Euros and include the legally required sales tax. Any delivery and shipping costs will be calculated separately. The prices for books and e-books are price-bound in Germany and Austria according to the Price Fixing Act. We cannot rule out price deviations due to erroneous entries or data deliveries. In this case, the prices according to the price binding shall apply.

§ 6 Delivery

The handover of printed works / books takes place by delivery to the address you provided. The handover of digital works / e-books takes place by providing the download link to the email address you provided. The delivery of the goods and the provision of digital works is carried out via our service partner, Verlegerdienst München GmbH, Gutenbergstraße 1, 82205 Gilching, Tel. 0800 44 55 644 (free of charge), E-Mail: hansershop@verlegerdienst.de

For the delivery of printed works / books, the delivery time is:

  • Germany: 2 to 4 working days
  • Austria and Switzerland: 2 to 5 working days
  • other countries: 2 to 18 working days

The handover of digital works / e-books usually takes place by sending an email with a download link to the email address you provided. You as the customer are responsible for executing the download. With the purchase, you acquire the simple, non-transferable right to use the acquired e-books exclusively for personal use in accordance with copyright law. It is not permitted to modify or edit a file or parts thereof in any way or to make it available to third parties, privately or commercially, in any way. We deliver our digital products with a personal digital signature ("watermark"), which indicates the lawful use of the e-book exclusively by the individual customer.

§ 7 Shipping Costs

Shipping within Germany is free of charge. For deliveries to all other countries, shipping costs are calculated as follows:

§ 8 Import Duties and Taxes

Import duties and taxes may apply to deliveries outside the EU. These fees must be borne by the buyer. The publisher has no influence on these fees, please inform yourself at your local customs authorities.

§ 9 Payment

The purchase price is due immediately and payable without deduction. You can pay by invoice (up to €199.99 shopping cart value), credit card (Visa and Mastercard), or PayPal. E-books can be purchased via PayPal or credit card and NOT by invoice. A purchase of e-books by invoice can only be made upon request to customer service support.

§ 10 Right of Withdrawal

Consumers are entitled to a statutory right of withdrawal as well as information about the statutory right of withdrawal. We provide this to you below in the form prescribed by law.

Please note that by ordering an e-book, you consent to the immediate execution of the service by providing a download link. The service claimed is thus provided by us upon conclusion of the contract, and you consequently waive your statutory right of withdrawal.

CANCELLATION POLICY

Right of Withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, have taken or has taken possession of the goods.

To exercise your right of withdrawal, you must inform us by means of a clear statement (e.g., a letter sent by post, fax, or email) of your decision to withdraw from this contract. You may use the model withdrawal form attached below for this purpose, but this is not mandatory.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning the exercise of the right of withdrawal before the withdrawal period has expired.

Consequences of Withdrawal

If you withdraw from this contract, we must refund all payments we have received from you, including delivery costs (with the exception of the additional costs resulting from your choosing a type of delivery other than the cheapest standard delivery offered by us), without delay and at the latest within fourteen days from the day on which we received the notification of your withdrawal from this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless something else was expressly agreed with you; in no case will you be charged any fees for this repayment.

We may refuse repayment until we have received the goods back or until you have provided proof that you have returned the goods, whichever is the earlier date.

You must return or hand over the goods to us without undue delay and in any case no later than fourteen days from the day on which you inform us of the withdrawal from this contract. The deadline is met if you send the goods before the period of fourteen days has expired.

We bear the costs of the return shipment within Germany if you return them with DHL using the return label "DHL Retour". You can obtain the return label at http://bit.ly/retoure-hanser. For returns from abroad, the buyer bears the cost of the return shipment.

You only have to pay for any loss in value of the goods if this loss in value is due to handling the goods in a manner that is not necessary for checking the quality, characteristics, and functioning of the goods.

End of Cancellation Policy

§ 11 Retention of Title

Until the purchase price claim has been paid in full by the buyer, every delivered work remains the property of the seller.

§ 12 Liability and Warranty

The statutory liability for defects applies.

We give no guarantee for the accessibility of the website and the constant access to digital products. Rather, we would like to expressly point out that access to the website hanser-literaturverlage.de and the execution of the download links for digital products may be temporarily unavailable or restricted due to maintenance work, security measures, or disruptions over which we have no control.

§ 13 Data Protection

We process personal data in accordance with the provisions of the European General Data Protection Regulation (GDPR), the new Federal Data Protection Act (BDSG n.F.) and the German Telemedia Act (TMG).

§ 14 Applicable Law, Place of Jurisdiction

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.

If the buyer is a merchant or a legal person under public law, the exclusive place of jurisdiction for all disputes arising from the contractual relationship is the court responsible for our company headquarters in Munich.
